In VietJet Aviation Joint Stock Company v FW Aviation (Holdings) 1 Ltd [2026] SGHC(A) 11, the Appellate Division of the High Court of Singapore (Appellate Division) affirmed that substituted service out of jurisdiction is permissible under the Rules of Court 2021 (ROC 2021), that the process is governed by Order 7 Rule 7 of the ROC 2021, and that the test to be applied in determining an application for substituted service out of jurisdiction remains one of impracticality of personal service.
Our Partner Wendy Lin and Senior Associate Sean Koh acted for the successful respondent before the Appellate Division.
This update takes a look at the Appellate Division’s decision.
